How to Become a Courtroom Influencer

This program explores how principles from cognitive and social psychology can help defense lawyers better understand how jurors think, remember information, and make decisions during trial. Drawing on real trial experience and decades of psychological research, the speaker explains why juror behavior often differs from what lawyers expect. Topics include cognitive biases such as the false consensus effect, group conformity during deliberations, and the limits of intuition when evaluating jurors. The presentation demonstrates why jurors may agree with the group even when they privately disagree and how group dynamics can influence verdicts.

 

The program provides practical insight into how jurors perceive and remember evidence. Through examples drawn from psychological studies—including research on perception errors, inattentional blindness, and memory reconstruction—the speaker explains why jurors often recall events differently from how they actually occurred. The training also examines how factors such as word choice, repetition, emotional framing, and suggestion can shape how jurors interpret testimony and what they ultimately remember during deliberations. These concepts help defense lawyers understand why seemingly small choices in language or presentation can significantly influence juror interpretation of the evidence.

Kelli Childress

Kelli Childress, El Paso County Public Defender, has focused her career on criminal litigation. She was previously the Chief Public Defender in Kane County, Illinois, Deputy Chief Public Defender in Lake County, Illinois, First Assistant Public Defender in DeKalb County, Illinois, a private practitioner and an Assistant State’s Attorney. Kelli received her JD from Loyola University Chicago, and a BA from Loyola as well, where she was a member of their Division I Women’s Volleyball team. She also earned a Professional Certificate in Organizational Psychology from the Chicago School of Professional Psychology. Kelli has held numerous board and committee positions nationally, taught CLE programs around the country, and appeared in several law-related television programming. She is also a faculty member of several trial advocacy programs across the country. Kelli lives in El Paso, Texas with her husband and two children.
