The Client Intake Interview: The Start of a Wonderful Relationship
This program focuses on one of the most critical—but least taught—skills in criminal defense practice: the initial client meeting. It reframes the first substantive interview as far more than an intake or fact-gathering exercise, emphasizing its simultaneous investigative, strategic, and relational importance. The program shows how decisions made in this first conversation—what to investigate, what to preserve, how to frame expectations, and how to build trust—can shape the entire trajectory of a case long before motions are filed or negotiations begin.
Criminal defense lawyers who watch this program will gain a structured, practical framework for conducting effective initial client interviews with confidence and intention. The program addresses preparation, setting, and pacing; explains how to manage the presence of family or other stakeholders without compromising privilege; and provides guidance on active listening that builds trust while still gathering critical information. It emphasizes the importance of explaining process, defining success from the client’s perspective, and correcting unrealistic expectations early—reducing misunderstandings that often lead to dissatisfaction later in the representation.
The program also delivers concrete tools that can be applied immediately in practice, including a step-by-step interview model that balances empathy with structure, mitigation with litigation, and listening with leadership. Special attention is given to high-stakes cases such as violent offenses and sexual assault, where stigma, fear, and emotional volatility demand heightened care and clarity. By teaching lawyers how to listen deeply, communicate candidly, and establish clear next steps, this program helps criminal defense attorneys gather better information, preserve critical evidence, and build the trust necessary for effective advocacy throughout the life of the case.
Steven Epstein is a founding partner at Barket Epstein Kearon Aldea & LoTurco, LLP and is the partner in charge of the firm's DWI and Vehicular Crimes group. Mr. Epstein has more than 28 years of experience in the field of criminal defense and is admitted to the New York State Bar, First Department, 1992; Connecticut Bar, 1992; United States Supreme Court, 1993 and United States District Court S.D.N.Y., N.D.N.Y. and E.D.N.Y, 1993. Mr. Epstein is widely recognized as one of the foremost DWI attorneys in the country, specializing in representing clients accused of DWI, vehicular homicides and other criminal offenses. Mr. Epstein has successfully defended individuals accused of vehicular homicides and has tried over 100 jury cases to verdict. In two recent and notable cases, Mr. Epstein was able to obtain a dismissal of all charges against a client charged with vehicular homicide in Suffolk County, and was successful in convincing the Westchester County District Attorney to decline to prosecute another client for vehicular homicide despite the existence of sufficient facts to initially accuse him of criminality. Both of these results were due to Mr. Epstein’s thorough investigation, expertise and knowledge of all aspects of vehicular homicide cases. Mr. Epstein drafted changes to discovery amendments that were submitted to the NYS Legislature and resulted in substantial changes to the way discovery will be conducted in DWI cases throughout the State with regard to expanding the scope of what types of records are now discoverable, expanding the time period relevant to discovery and codifying a landmark decision from one of his cases, Singas v Engel, 155 A.D.3d 877 (App. Div. 2d Dept. 2017) making Gas Chromatography records related to the certification of simulator solutions used in breath testing discoverable.
