The Science of Cannabis and THC

This CLE program explores the intersection of constitutional rights and drug testing practices in the context of pretrial and probation conditions. Viewers will receive a detailed analysis of how drug testing—particularly for cannabis—has evolved in a post-legalization landscape, and how its continued use can pose constitutional challenges under the Fourth and Fourteenth Amendments. The presentation breaks down recent case law and statutory developments that defense attorneys can use to push back against arbitrary or unnecessary testing conditions.

 

Particular focus is given to the implications of medical marijuana laws, state legalization statutes, and evolving norms around cannabis use and possession. The speaker addresses how courts are grappling with privacy rights, probationary discretion, and the limits of governmental authority when imposing drug testing as a condition of release or supervision. Daniel Mehler is an attorney based in San Antonio, Texas. He is licensed in the State of Texas and in Federal Court in the Western District of Texas, the Northern District of Texas, and the District of Colorado. He has a Masters in Medical Cannabis Science and Therapeutics from the University of Maryland School of Pharmacy and his practice is focused on the defense of cannabis and drug cases. He also works as a consulting and testifying expert for the defense, having testified numerous times in both state and federal court.
