"Write Away!" Better Legal Writing for Better Results on Motions and Appeals
This program is a practical, defense-focused guide to legal writing that actually wins motions and appeals. It starts from a simple but often overlooked truth: judges read what defense lawyers write, and written advocacy is one of the most powerful tools available to protect clients. The program challenges the common habit of recycling boilerplate or copying motions from listservs, explaining why that approach undermines credibility and weakens outcomes. Instead, it teaches lawyers how to view every filing—motions, briefs, letters, sentencing memoranda—as an opportunity to persuade, educate, and build professional trust with the court.
Criminal defense lawyers who watch this program will gain concrete guidance on how to write clearly, persuasively, and strategically for judicial audiences. Richard Willstatter is a New York lawyer and a partner at Green & Willstater in White Plains, New York. Mr. Willstatter is a past President of the New York State Association of Criminal Defense Lawyers and is active in NYSACDL’s Amicus Curiae and Conditions of Confinement committees. Mr. Willstatter practices in New York and federal courts including both trial and appellate work. Mr. Willstatter serves on NACDL’s Board of Directors. He chairs its Discovery Reform Committee and is an active member of NACDL’s Amicus Curiae, Corrections and Membership Committees. He has advocated for the appointment of a Receiver to take over Rikers Island in New York City and for better access to counsel for clients held in federal detention nationwide. Recently, he opposed an initiative aimed at repealing the discovery reform laws that were enacted in New York in 2019. Mr. Willstatter has won significant victories including those reversing murder and felony assault convictions, a federal habeas corpus petition from a state court conviction, and sex offender registration appeals. His retained work has included representing physicians charged with health care fraud, lawyers charged with bank fraud, and business owners charged with insurance fraud. He also proudly serves on the Criminal Justice Act Panel for the Southern District of New York.
