Tell Me All Your Secrets: Getting Potential Jurors to Share

This program teaches criminal defense lawyers how to transform voir dire from a guarded, surface-level exercise into a meaningful conversation that uncovers jurors’ true beliefs, biases, and decision-making tendencies. Rather than relying on generic “can you be fair?” questions, the program emphasizes intentional questioning designed to get jurors to actually talk—about law enforcement, burden of proof, punishment, addiction, credibility, and implicit bias. By working backward from the jury charge and statutory elements, the program shows how to structure voir dire so that it frames the case, educates the panel, and identifies jurors who cannot follow the law before trial ever begins.

 

Criminal defense lawyers who watch this program will gain a practical, step-by-step framework for organizing voir dire into focused “blocks” that correspond to constitutional rights, case elements, and the unavoidable “elephants” in the room. The program provides formulas for crafting effective cause questions, identifying vacillating and equivocating jurors, and locking in answers that support challenges for cause. It also explains how and when to use written juror questionnaires to gather core values information, reduce juror fear, and surface disqualifying attitudes that might never be revealed in open court.

 

The program also delivers courtroom-ready techniques for managing the realities of jury selection—limited attention spans, judge-specific rules, and time pressure—without sacrificing effectiveness. Jen Falk joined McCathern’s Dallas office as a Partner in 2022 after a nearly two decade career in the Houston and Dallas District Attorney’s Office and after trying nearly 150 jury trials. Jen has extensive experience handling high-pressure and high-exposure legal matters, across several practice areas, including Business & Commercial Litigation and Criminal Defense. Jen is Board Certified® in Criminal Law by the Texas Board of Legal Specialization, she is a Texas Bar Foundation Fellow, member of the Dallas Women Lawyers Foundation, and is active with both the Dallas Women Lawyers Foundation and Dallas Bar Association; along with numerous other organizations. Jen has served as the Course Director for both the State Bar of Texas’ Criminal Law 101 and Advanced Criminal Law Course, where she previously served as a speaker and track moderator. She has been a speaker on criminal law, with a focus on advocacy skills, for numerous conferences and at various law schools.
